King Attempts To Crush The Banner Saga Developers

Candy Crush Saga creators King haven’t exactly painted themselves in a very positive light over the past few days. Not content with bizarrely trademarking the word ‘candy’, the developer of legions of ‘match-3’ games is also trying to get its mitts on the word ‘saga’.

The news came to light when The Banner Saga developers Stoic revealed that a Notice of Opposition had been filed at the US Patent and Trademark Office, claiming that Stoic were being deliberately deceptive in their use of the word ‘saga’...

King suggested that "The Banner Saga mark is confusingly and deceptively similar to Opposer's previously used Saga Marks.The use and registration by Applicant of the mark The Banner Saga for Applicant's goods is likely to cause confusion or to cause mistake or deception in the trade, and among purchasers and potential purchasers, with Opposer's Saga Marks, again resulting in damage to Opposer."

Of course it’s obviously a very easy mistake for customers to confuse the two. One is a high-quality turn-based strategy affair steeped in Norse mythology, the other is a match-three game about saccharine sweets and colourful candy.

This news follows King’s decision to trademark ‘candy’, requesting developers to remove any games from the iOS store featuring that single innocuous word. King now owns the trademark to the work ‘candy’ in any of its uses relating to games, clothing and electronics. Any use of this word is deemed as infringing on their intellectual property rights.

It hasn’t taken long for some indie devs to start an uprising though, with a game jam dubbed Candy Jam. Developers are tasked with making a game involving candies, with bonus points for the word saga. The rules for would-be developers are to “consider using the word ‘candy’ several times”.

So far it seems King hasn’t really achieved much beyond free publicity for The Banner Saga.

They shouldn't be allowed to trademark a single word, unfortunately a lot of people who play candy crush (E.g. my parents) won't see this as they're not gamers and they won't realise what a asshole of a company King is turning out to be.
